Terms of Service

Article 1 (Purpose)

These Terms of Service govern the rights, obligations, and responsibilities between TWMS (hereinafter "Company") and users regarding the use of the Instagram comment-based automatic DM sending service (hereinafter "Service").

Article 2 (Definitions)

  • "Service" refers to the Instagram comment trigger-based automatic DM sending function and related additional features provided by the Company.
  • "User" refers to members who use the Service provided by the Company in accordance with these Terms.
  • "Trigger" refers to settings that execute automatic DM sending based on specific keywords or conditions.
  • "Account Integration" refers to connecting the user's Instagram business account with the Service.

Article 3 (Effect and Amendment of Terms)

  1. These Terms become effective when posted on the Service screen or notified to users through other means.
  2. The Company may amend these Terms within the scope that does not violate relevant laws, and amended Terms will be announced through notices within the Service.
  3. If users do not agree to the amended Terms, they may discontinue using the Service and withdraw their membership.

Article 4 (Service Usage Requirements)

  1. An Instagram Business or Creator account is required to use the Service.
  2. Users must comply with Meta (Facebook) platform policies and Instagram Terms of Service.
  3. Users must be at least 14 years old, and minors require consent from a legal guardian.
  4. Users must provide accurate information when registering, and service usage may be restricted if false information is provided.

Article 5 (Service Content)

The Company provides the following services:

  • Real-time monitoring of Instagram post comments
  • Keyword-based trigger setup and management
  • Automatic DM sending based on conditions
  • Sending history and statistics
  • Other additional services determined by the Company

Article 6 (User Obligations)

Users shall not engage in the following activities:

  • Stealing others' accounts or registering false information
  • Using the Service for illegal purposes such as spam, phishing, or fraud
  • Sending messages that violate Instagram platform policies
  • Interfering with the normal operation of the Service or overloading the system
  • Infringing on the Company's intellectual property rights
  • Other activities that violate relevant laws or public morals

Article 7 (Service Changes and Suspension)

  1. The Company may change all or part of the Service for improvement purposes.
  2. The Company may temporarily suspend service provision in the following cases:
    • System inspection, maintenance, or replacement
    • Force majeure circumstances such as natural disasters or national emergencies
    • Instagram API or Meta platform failures
  3. The Company will provide advance notice for service suspension, or post-notice in unavoidable circumstances.

Article 8 (Fees and Payment)

  1. Paid plan fees are charged as monthly recurring payments.
  2. The monthly DM sending limits for each plan are as follows:
    • FREE: 50 messages
    • MINIMUM: 500 messages
    • STARTER: 1,500 messages
    • PRO: 10,000 messages
  3. DM Sending Limit Policy
    • When you reach 90% of your monthly DM sending limit, a warning notification will be sent via email.
    • When you reach 100% of your monthly DM sending limit, additional sending will be automatically blocked.
    • Blocked sending will resume when the limit is reset on the next billing date.
    • No overage charges will occur.
  4. Plan upgrades take effect immediately, and usage is reset to 0.
  5. Plan downgrades take effect after the current billing cycle ends.

Article 9 (Refund Policy)

  1. Subscription cancellations are non-refundable, and you may continue using the Service until the end of the current billing cycle.
  2. Refunds are available in cases of payment errors or system failures that cause damage.
  3. Refunds for Subscription Policy Changes
    • When transitioning due to subscription policy changes, credits for the remaining subscription period will be automatically applied.
    • Credits will be automatically deducted from the next payment.
    • If you prefer a cash refund, please contact customer service within 7 days of the transition date.
    • Refund amounts are prorated and processed within 5-7 business days.

Article 10 (Service Usage Restrictions)

  1. The Company may restrict service usage or suspend accounts if users violate these Terms or interfere with normal service operation.
  2. Service may be restricted if service provision becomes difficult due to policy changes by Instagram or Meta platforms.
  3. Service usage may become unavailable if the user's Instagram account is suspended or deleted.

Article 11 (Service Cancellation)

  1. Users may cancel their subscription at any time and continue using the Service until the end of the current billing period.
  2. After cancellation, the subscription will not auto-renew.
  3. Plan changes are available at any time, and the changed plan will be applied from the next billing date.

Article 12 (Intellectual Property)

  1. Copyright and intellectual property rights to the Service belong to the Company.
  2. Users may not reproduce, distribute, publish, broadcast, or provide to third parties any information obtained through the Service without the Company's prior consent.
  3. Copyright of content posted by users within the Service belongs to the respective users.

Article 13 (Disclaimer)

  1. The Company is exempt from liability when unable to provide the Service due to force majeure such as natural disasters, war, or telecommunications service interruption.
  2. The Company is not liable for service usage disruptions caused by the user's fault.
  3. The Company is not liable for the content of messages sent by users through the Service.
  4. The Company is not liable for issues arising from Instagram or Meta platform policy changes, API restrictions, or service failures.
  5. The Company is not liable for any disadvantages to Instagram accounts resulting from the user's use of the Service.

Article 14 (Privacy Protection)

  1. The Company protects users' personal information in accordance with relevant laws and the Privacy Policy.
  2. The Company collects only the minimum personal information necessary for service provision.
  3. Matters regarding the collection, use, storage, and destruction of personal information are provided through a separate Privacy Policy.

Article 15 (Dispute Resolution)

  1. Disputes between the Company and users shall be resolved through mutual consultation.
  2. If consultation fails, disputes shall be resolved in courts with jurisdiction according to relevant laws.
  3. The laws of the Republic of Korea shall apply to the interpretation and application of these Terms.

Supplementary Provisions

These Terms shall take effect from January 24, 2026.
